Acceptable Use Policy

This Acceptable Use Policy (AUP) governs the permitted and prohibited conduct when using the 5ac.vn AI Agent platform.

1. Purpose

This Acceptable Use Policy ("AUP") governs the permitted and prohibited conduct when using the 5ac.vn AI Agent platform (the "Service"). This policy applies to all users, customers, partners, and any party accessing or using the Service.

2. Prohibited Conduct

You must not use the Service for any of the following purposes:

2.1 Spam and Unauthorized Communications

• Sending spam, unsolicited bulk messages, or unauthorized email marketing through the Service.
• Using the AI Agent to generate content for fraudulent purposes, phishing, or impersonation of individuals/organizations.
• Collecting email addresses or contact information of other users without consent.

2.2 Malware

• Distributing or creating malware, viruses, trojans, ransomware, worms, backdoors, or any other malicious software through the Service.
• Using the Service to exploit security vulnerabilities or carry out cyber attacks.
• Using the Service to write or generate exploit code.

2.3 PII Scraping

• Collecting, extracting, or aggregating personal data (PII) of any individual without lawful consent.
• Building personal profiles of other users without a legal basis.
• Using the Service to perform unauthorized web scraping of other websites.

2.4 Intellectual Property Infringement (IP)

• Uploading, sharing, or generating content that infringes the copyright, trademark, patent, or trade secrets of any third party.
• Using the Service to create unauthorized copies of copyrighted works.
• Distributing content that infringes intellectual property rights through AI Agent output.

2.5 High-Risk AI Decisions

Using AI Agent output to make high-risk decisions without human oversight, including but not limited to:

• Medical: Diagnosing diseases, prescribing medication, or providing emergency medical advice.
• Legal: Providing legal advice or drafting binding legal documents.
• Financial: Making automated investment, lending, or insurance decisions.
• Safety: Operating autonomous vehicles, controlling industrial equipment, or life-safety systems.
• HR: Making automated hiring, termination, or employee evaluation decisions.

3. Prohibited Content

You must not use the Service to create, upload, share, or distribute content that:

• Child sexual abuse material or child exploitation in any form.
• Terrorism or radicalization: Content that promotes, supports, or instructs terrorist activities.
• Hate speech: Content that incites hatred, racial discrimination, sexism, religious intolerance, or discrimination based on sexual orientation.
• Violence and cruelty: Content depicting extreme violence, torture, or harm to animals.
• Suicide and self-harm: Content that instructs or encourages suicide, self-harm, or eating disorders.
• Illegal content: Any content that violates Vietnamese law or applicable international law.
• Privacy violations: Content that discloses sensitive personal information of others without consent.

4. Monitoring and Enforcement

4.1 Monitoring

We have the right, but not the obligation, to monitor input and output content of the Service to detect violations of this policy. We may use:

• Automated violation detection systems
• Periodic manual reviews
• Reports from other users

4.2 Enforcement

Upon detecting a violation, we may take one or more of the following actions:

• Warning the user
• Suspending or disabling the account
• Blocking access to the Service
• Removing violating content
• Reporting to the relevant law enforcement authorities
• Seeking damages as provided by law

5. Reporting Violations

If you discover conduct that violates this Acceptable Use Policy, please report it to us immediately at:

• A detailed description of the violating conduct
• Relevant evidence (screenshots, URLs, etc.)
• The time the violation occurred
• Contact information of the person reporting

6. Consequences of Violation

6.1 Account consequences

• Minor first offense: Written warning and request for remediation within 48 hours.
• Serious violation or repeat offense: Immediate account suspension.
• Extremely serious violation (illegal content, terrorism, child exploitation): Permanent account disablement and reporting to authorities.

6.2 Legal consequences

Users who violate this policy bear full legal responsibility under Vietnamese law and applicable international regulations. 5ac.vn has the right to initiate legal proceedings or seek damages arising from the violation.

6.3 No refunds

In the event that an account is disabled due to violation of this policy, the user will not be entitled to a refund of any fees already paid.

7. Appeals

If you believe your account has been wrongly sanctioned or that mitigating circumstances exist, you have the right to appeal:

7.1 Appeal process

1. Send an appeal email to legal@5ac.vn with the subject line "AUP Appeal - [Account name]"
2. Provide complete information:
   • The account name/IP that was sanctioned
   • The decision being appealed
   • Reasons for the appeal and supporting evidence
3. We will review and respond within 14 business days

7.2 Appeal outcomes

• Upheld: Account restored and violation removed from record.
• Denied: Original decision maintained, with an explanation of reasons.
• Mitigated: Penalty reduced if mitigating circumstances are found.
